Well, he belongs to a military family who recently moved to the area. They seemed confused at how he ended up tethered to a tree in the middle of nowhere, and said their back yard gate was open when they came home two days earlier, and he was gone. Maybe it was the Westie owner's choice? I would be absolutely HORRIFIED if one of my dogs severely bit a child, and might put them down over it, too! Maybe the owner felt compelled to have the dog PTS since he/she felt they couldn't trust the dog anymore, or maybe they couldn't afford or didn't want...
